Short-Term Rental Guest Terms & Conditions (Tasmania)

1. Acceptance of Terms

By confirming and paying for a booking at the property (“Property”), the guest agrees to comply with and be bound by these Terms and Conditions. These Terms apply to all guests and visitors attending the Property during the booking period.

2. Booking and Payment

All bookings are subject to availability and confirmation by the host.

The guest agrees to pay:

The total accommodation tariff;
Any applicable cleaning fees;
Security or damage deposits;
Additional guest fees where applicable; and
Any charges arising from breaches of these Terms and Conditions.

Bookings may be cancelled if payment is not received by the required due date.

3. Security / Damage Deposit

A security or damage deposit may be required prior to check-in. The guest authorises the host to deduct from the deposit, or otherwise recover, any costs associated with:

Damage to the Property;
Missing items;
Excessive cleaning;
Additional guests not included in the booking;
Breaches of these Terms and Conditions; or
Any other loss caused by the guest or their visitors.
Broken house rules

Where damages or losses exceed the security deposit amount, the guest agrees to pay all additional costs incurred.

4. Property Condition and Guest Responsibility

The Property is provided in good condition and must be left in a similar condition at check-out, allowing for fair wear and tear.

No prior condition report will be provided to the guest before arrival. It is the guest’s responsibility to inspect the Property immediately upon check-in.

Any existing damage, maintenance issue, missing item, or cleanliness concern must be reported to the host promptly after check-in. Failure to notify the host of any issue upon arrival will result in the guest being deemed responsible for any unreported damage, missing items, or issues identified after departure.

5. Guest Liability for Damage

The guest is fully liable for any loss, damage, breakage, theft, or additional cleaning caused by the guest or any person attending the Property during the booking period.

The guest agrees to pay all costs associated with repairs, replacement, cleaning, or rectification in accordance with these Terms and Conditions.

6. Occupancy and Visitors

Only the number of guests stated in the booking confirmation may stay overnight at the Property unless prior written approval is obtained from the host.

Parties, events, excessive noise, or unlawful activity are strictly prohibited.

The host reserves the right to terminate the booking immediately if these conditions are breached.

7. Check-In and Check-Out

Guests must comply with the check-in and check-out times provided by the host unless otherwise agreed in writing.

Late check-out without approval may incur additional charges.

8. Cleanliness and Waste

Guests must keep the Property reasonably clean and tidy during their stay and ensure rubbish is disposed of appropriately.

Excessive cleaning required after check-out may result in additional charges.

9. Smoking and Pets

Smoking is prohibited inside the Property unless expressly permitted in writing.

Pets are not permitted unless specifically approved by the host prior to arrival.

Additional cleaning or damage charges may apply where these conditions are breached.

10. Liability and Indemnity

Guests occupy and use the Property at their own risk.

To the maximum extent permitted by law, the host is not liable for:

Loss or damage to personal belongings;
Injury, illness, or accidents occurring at the Property;
Temporary interruption to utilities, internet, or services beyond the host’s control.

The guest agrees to indemnify the host against any claims, damages, losses, or expenses arising from the guest’s use of the Property or breach of these Terms.

11. Cancellation and Refunds

Cancellation policies will apply as stated at the time of booking or on the booking platform used.

Refunds are at the host’s discretion unless otherwise required under Australian Consumer Law.

12. Breach of Terms

Failure to comply with these Terms and Conditions may result in:

Immediate termination of the booking;
Eviction from the Property without refund; and/or
Additional charges for damages, cleaning, or losses.
We reserve the right to refer any outstanding monies owed to us to a credit agency for collection

13. Governing Law

These Terms and Conditions are governed by the laws of Tasmania and Australia. Any disputes arising from the booking or stay will be subject to the jurisdiction of the courts of Tasmania.
